To the extent allowed by applicable legislation, our services and products are sold without warranty. Without any express or implied guarantees of any kind, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, BrothersItbd.Net and its representatives deliver the items and services as is. You bear all risk regarding the functionality and caliber of the services and goods provided by BrothersItbd.Net. You are liable for all necessary servicing, repair, or correction costs in the event that the products or services turn out to be defective.

Liability

Any BrothersItbd.Net representative shall not be liable to you for any damages, including any special, incidental, general, or consequential damages arising out of the use or inability to use the products and services (including, but not limited to, lost or inaccurately rendered data, losses incurred by you or third parties, or a failure of the services or products to operate with any programs), unless required by applicable law or agreed to in writing. This disclaimer applies even if the holder or other party has been informed that such damages may occur.

Publicity

Users using database and API services are allowed to declare their usage of the services openly. Every client acknowledges that BrothersItbd.Net may use their name and trademarks in advertising materials, on the internet, or in a list of their clients. Any customer may contact BrothersItbd.Net’s customer care at any time to opt out of the terms in this section.

Licensing terms

The product or service is licensed to an individual or entity for exclusive use. This license is not transferable. The purchased database license is valid indefinitely for the database edition available at the time of purchase and for any subsequent database editions available during the included renewal period. This license grants the owner the right to use the database in as many projects as necessary, on as many physical or virtual servers or devices as necessary, but it may not be redistributed in any form, including derivative works, or made available to the public; in any case, as long as they are all owned or rented to the same natural or legal person. This license expressly prohibits the use of the database to provide free or commercial IP Geolocation API services, or any other related services that replicate or compete with the services offered by BrothersItbd.Net. Licensee acknowledges that it has no rights to BrothersItbd.Net’s intellectual property and that all such rights belong to BrothersItbd.Net.

Uptime guarantees

Some of our API Services come with availability guarantees, and we engage third parties to measure the availability of our API Services. When we receive your invoice, we will check it against our metering service, and if we find that your monthly availability is below our guaranteed limits, we will credit you an amount equal to 50% of your monthly subscription amount.

Refund policy

We will refund your purchase, provided that no download key or API key has been used to download the database. To receive a refund, you must make the request using the contact link on our website within 30 days of purchase. If you purchased the wrong database, do not use the download link you received via email. In case of an API key, do not use this key to query the API service. We will immediately refund any purchaser who contacts us, as long as they fulfill the previous requirements.
